Author Andrea Bjorklund, for example, is Professor of Law at the University of California at Davis and visiting professor at McGill University's School of Law in Montreal. August Reinisch is Professor International and European Law at the University of Vienna and lectures at the Bologna Center of Johns Hopkins University. Their fellow contributors hail variously from Dundee in Scotland to Jerusalem, to Wittenberg in Germany. We have here, therefore, an international perspective on the topic. The various contributors we have referred to were members of a study group that had concluded its work with the publication of the 'Oxford Handbook on International Investment Law' which addressed major issues relating to both substantive and procedural investment law. As explained by several of the contributors, including Moshe Hirsch, who writes the second chapter, soft law rules are not legally binding and it is up to the discretion of legal decision-makers as to whether or not such rules can be applied to a particular dispute. His chapter in particular briefly discusses, among other topics, the interactions between 'soft law' (non-binding instruments) and the recognized sources of investment law. The views of this group of international experts do shed interesting light on such matters as GATT/WTO and certain fields in particular, namely commercial law, environmental law, as well as investment law. Fundamentally, the various chapters attempt to answer the general question of whether investment law can, or should be 'codified', with special reference to such issues as most favoured nation treatment and also, expropriation. Extensively footnoted throughout, with a detailed index at the back, the book covers an exceptionally wide range of issues in the process of examining the topic of investment law and soft law. Taxation of Foreign Investment in the US and IRS Form 5472
Don't let the complicated US tax code stop you from investing in the US. The IRS is something to be concerned about, but it can be managed. The Recently passed Tax Reform Bill with a 21% corporate "C" tax rate and Qualified Business Deduction for pass-though taxpayers is generating considerable interest from non-US persons who are looking on a sure investment in the US. https://www.irsmedic.com/kb/services/international-tax-issues/business/foreign-investment-in-us.html But numerous tax trap exists for those unfamiliar and somewhat familiar with the US tax code, the most complicated in the world. The decision to have income treated a FDAP (Fixed, Determinable, Annual or Periodic income. FDAP income applies to foreign persons earning income in the U.S; such persons will be subject to 30% withholding tax, or a lower rate if there is a tax treaty between the United States and the country of residency) or effectively connected is just one decision that needs to be made with care. Additionally, exercising due diligence to make sure that if an IRS Form 5472 is required that due to 25% foreign ownership of a corporation, or new in 2017, a domestic US LLC, with related party transaction is key. As the penalties for not filing a proper form 5472 are now increased to $25,000 from $10,000. The penalties can be assessed for multiple years. The IRS is on the look out for improper Form 5472 or missing Form 5472 and audits abound. Many corporations with 5472 requirement are choosing to entire into a voluntary disclosure program to eliminate or reduce outstanding Forms 5472. Cuba passes law to attract foreign investors
Cuba continues to open up to the outside world. Its National Assembly has just passed a law to encourage foreign investment. Taxes on profits will be cut in half, from 30 to 15 percent. The aim is to raise foreign direct investment to $2 bn a year. It's part of Raul Castro's reforms for an economy that has been under a US trade embargo since 1960. Al Jazeera's Daniel Schweimler reports from Havana.

This is despite Angela Merkel's government spending a lot of money on subsidies promoting and helping families. So why has this investment seemingly not payed off? Euronews spoke to Marlene Griesser who chose to put her son in day care when he was 9 months old: "I was divided, I wanted to finish my teacher training. And then a lot of time passed by. It was just too long. I wanted to do something for myself, because I had a long break between the two kids where I didn't work. And it encouraged me to do something else."  Marlene added: "People sometimes said to me: 'How come you've got such a small child and yet you're doing your teacher training at the same time? How do you cope?' They were surprised, but not dismissive. Sometimes my girlfriends who go back to work very early tell me that it has a strange reputation in Germany because usually women stop for at least a year or longer. Sometimes there's a bit of disapproval in the community." To help increase the birthrate Angela Merkel's government decided to fork out family subsidies amounting to 200 billion euros a year. But this seems to have had little success. A huge project to construct day care centres in Germany could be one way to change the trend. It's a system that is well developed in France and Scandinavian countries, which also boast higher birthrates. So by August 1st, everyone in Germany was promised a place in day care, if needed. The Ministry for Family called it a 'success story'. But according to the German Association of Towns and Municipalities there were still 100,000 places missing. Euronews spoke to Udo Drews and Sabine Radtke who had still not been allocated a place at a day care centre after more than a year. The delay meant they had to choose a private one -- which was more than twice the cost of a public facility. A full-time place there costs more than 1,000 euro a month. Sabine explained: "I'm disillusioned, not angry. I think we are lucky because we have flexible employers and we've found a private centre which we like. But I'm disillusioned because the government promises more than it can fulfill and we are paying more then we ever imagined. It doesn't fit with all the positive news about how good the situation is." Other parents in their situation have opted for a nanny which is far more expensive. The government's recent promises have turned out to be very costly for some families. In Cologne, where half of children aged between one and two received a place in day care, some 80 parents pressed charges against the city. However, in East Germany the measures have been a little easier to achieve because of its communist past, where day care centres were already quite normal. Dr Agnes Klein, head of the family department on Cologne city council said: "We've arrived at a turning point. I can remember discussions I had eight years ago, when people in Germany talked about the possible damage on children who were in school all day. If this works in other European countries, why should it damage German children?" So why do qualified women in Germany have no children at all, or why do they tend to start a family later in life? Some students think it's because of the country's long studies. "I know students in other countries who also study law but they finish earlier. This means they can start work earlier and then you can start thinking of having a family" suggested Maria Anochin, a law student. Shirin Imani, also a student, said: "I think it's extremely difficult to stop once you've started working because by then you like your job and you think: now I want to take the next step at work and only after that I'll think of having a family. I think at some point you just have to take the leap and stop working, but you'll always think that you probably won't get the same opportunities after giving birth." In Germany, more women then men have higher education qualifications but most of the executive posts are still in the hands of men. Burma Places Hopes for Development in Foreign Investment

But development must include all of society and be sustainable for Burma to reach its goals. That is what the Asian Development Bank said in a recent report.Cyn-Young Park is an economist with the bank. She says Burma's economic position is strengthened by its natural resources, such as oil, gas and minerals. It also has two large, growing neighbors: India and China. And the nation is young: one in four of its citizens are under the age of 30.But Burma has a long way to go. After 50 years of military rule, it is one of Asia's poorest countries. Basic infrastructure, like roads, bridges and railways, are not developed. And only 30 percent of rural people have electricity.Burma is trying to increase foreign investment. Its civilian government has struggled with a new foreign investment law. Some versions of the law restricted foreign ownership in some industries and ban it completely in others.Sean Turnell is an economist with Australia's Macquarie University. He said the foreign investment law faced local disapproval, or push back. He said in some cases there appears to be a "walling off" of some industries to foreigners. For years, Burma's military closely controlled the economy. Relatives and friends of military members received rich contracts. Now, the civilian government wants to expand services and manufacturing. It has considered giving foreign companies low tax rates so they will invest. But experts say this could be a mistake. Sean Turnell says investors are concerned about infrastructure problems, not taxes. Economists also say tax breaks for local businesses may not be the answer either. They say the lack of access to credit for farmers and businesses in Burma is a bigger problem.Reform in Burma is still in the early stages. The country recently announced new rules ending direct government censorship of news media. Reporters now must send censors their work after it is published, instead of before. Some reporters say they will wait to see if this means more freedom. Cyn-Young Park says investors too are waiting to see if reform will succeed. "It is really going to take a while," she says, "before the investors do believe that this reform is sincere and the government is not going to retrench."For VOA Special English, I'm Laurel Bowman.
