This is due to the perceived impracticality of registering traded securities in the name of each individual holder; instead, the custodian or custodians are registered as the holders and hold the securities in a fiduciary arrangement for the ultimate security holders. However, the ultimate security holders are still the legal owners of the securities. They are not merely beneficiaries of the custodian as a trustee. The custodian does not become at any point the owner of the securities, but is only a part of the registration chain linking the owners to the securities. Global securities safekeeping practices vary substantially with markets such as the UK, Australia and South Africa encouraging designated securities accounts in order to permit shareholder identification by companies. The definition of "shareholder" is generally upheld by corporate law rather than securities law. One role of custodians (which may or may not be enforced by securities regulation) is to facilitate the exercise of share ownership rights, for example and processing dividends and other payments, corporate actions, the proceeds of a stock split or a reverse stock split, the ability to vote in the company's annual general meeting (AGM), information and reports sent from the company and so forth. The extent to which such services are offered are a function of the client agreement together with relevant market rules, regulations and laws.

These two features are advantageous to their clients. The prime broker benefits by earning fees ("spreads") on financing the client's margined long and short cash and security positions, and by charging, in some cases, fees for clearing and other services. It also earns money by rehypothecating the margined portfolios of the hedge funds currently serviced and charging interest on those borrowing securities and other investments.

Vanguard and full-service brokerage funds
Vanguard vs. Fidelity After Fidelity, Vanguard is America's second largest mutual fund family, with nearly 100 mutual funds. In many ways Vanguard is the exact opposite of Fidelity. Whereas Fidelity likes active trading and isn't afraid of risk, Vanguard prefers passive index investing and is generally conservative. While Fidelity excels at stocks but lags in bonds, Vanguard is great in bonds but doesn't have a great stock picking reputation. Fidelity also advertises heavily and sells its load and no-load funds through any channel it can find. Vanguard advertises little and offers only no-loads. And if you want to invest with Vanguard, get ready to pick up the phone and lick some stamps because it only sells its funds directly. Vanguard will save you money But if you like to save money and believe that it's tough to beat the market, Vanguard is the place to be. Vanguard introduced the first stock index fund modeled after the Standard & Poors 500 index in 1976, and this fund is the benchmark for all other stock funds. Since its inception, the fund has outperformed 75 percent of other actively managed stock funds, partly because it has very low management fees of only 0.2 percent, compared with about 1.4 percent for the average stock fund. This stock index fund is also one of the largest stock funds around, showing that a lot of people believe in indexing. Although you may never have heard of Vanguard, this is probably no accident. To keep its expenses low, Vanguard advertises little. Although Vanguard may be little known to newcomers, you should look into Vanguard if you're not afraid to manage your own money. Merrill Lynch Unlike Vanguard, Merrill Lynch is a well known name. Merrill Lynch is the sixth largest provider of mutual funds. Merrill Lynch, of course, is also one of the old-line, so-called full-service brokers. It provides a wide range of services to a variety of customers. You can buy individual stocks, bonds and mutual funds from full-service brokers. But these brokerages have investment bank divisions which make a great deal of money by serving corporations. Whenever a company issues stocks or bonds, they almost always turn to a company like Merrill Lynch. Potential conflicts of interest with investment banks This can cause a conflict of interest for the mutual funds offered by Merrill Lynch and its brethren like Prudential, Smith Barney, Dean Witter and Oppenheimer. The two largest mutual fund families, Fidelity and Vanguard, are first and foremost mutual fund companies. Fidelity and Vanguard both offer discount brokerage services, but these two companies owe their success to serving their mutual fund customers. When it comes to things like investing in new stock issues, funds managed by investment banks like Merrill Lynch may be torn between getting the best deal for it's corporate customers, or serving it's individual mutual fund investors. Perhaps because of conflicts like this, mutual funds offered by Merrill Lynch and it's cousins are generally poor performers. They're often expensive and almost always have high front or back-end loads. For example, as I was reviewing mutual fund families in preparation for this tape, I was shocked at some of the expenses that companies like Oppenheimer were charging for their mediocre stock and bond funds. Insurers as providers of fixed income investments So far we've taken a look at the safe and stable world of fixed income investing, namely bank deposits and money market mutual funds. However, before we enter the wilder world of bond investing, let's consider fixed income investments offered by insurance companies. Many people only think of insurance companies as places to file a claim, but insurance companies are large financial intermediaries that lend money like banks and make investments like mutual funds. In fact, life insurance companies make a lot of money by first collecting insurance premiums, and then investing the premiums so that the investment returns are higher than the return promised to the policy holder. Insurers act as an investment intermediary for not only cash value life insurance, but also for financial products which have little or nothing to do with insurance. GICs Guaranteed investment contracts, otherwise called GICs, are a good example of these products. These are large-scale financial products offered by life insurers. It's doubtful that you can invest in a GIC by yourself, but there's a good chance that your employer will allow you to invest in GICs through the company's 401(k) or other retirement plan. In this case, the guaranteed investment contract may be called the "Stable Income Fund" or something similar. If you invest in a GIC, you give the insurer some money, and the insurer promises to give your money back plus a guaranteed rate of return. This is where the "guaranteed" part of GICs comes from. Note that the insurer only guarantees the rate of return. Your investment is not guaranteed by a federal agency, although many states provide some kind of insurance to bail out insurers if they go under. So a guaranteed investment contract is like investing in a bond or a bank certificate of deposit, and GIC yields are roughly equal to bank CD rates. Also, like bank CDs, most GICs restrict your ability to withdraw money before the end of the contract. The GIC should be safer than investing in a single bond issued by, for example, General Motors. The insurer takes your money and invests it in a variety of bonds and other securities, so a GIC reduces risks by diversifying its investments. But GICs are not risk free, in spite of the nice sounding name of "guaranteed investment contract". The thing to watch out for with a GIC is the solvency of the insurer. As investors found out in the late 1980s with the insolvency of two large insurers that invested heavily in junk bonds, insurers can and do go bankrupt. Eventually, investors got a good portion of their money back, but their money was tied up for years in bankruptcy courts. Before you invest in a GIC, make sure you check out the financial stability of the underlying insurer. There are a number of insurance rating services, including AM Best and Weiss Research that provide credit ratings for insurers. Check with your library for more information about these insurance rating services. Fixed annuities Fixed annuities are another investment offered by insurance companies. Annuities come in two flavors, fixed and variable. Fixed annuities generally invest in bonds and offer a guaranteed rate of return for the life of the contracted annuity. Variable annuities normally invest in stocks. If the underlying stocks go up, you could do better than if you had used a fixed annuity. But if stocks go down, the fixed annuity would have been better. Characteristics of annuities Annuities are retirement investment vehicles offered by insurance companies. Annuities offer tax-deferred growth of your investment, but you can't remove funds from the annuity without facing a tax penalty until you reach age 59.5. Insurance agents chat up the tax-deferred savings aspects of annuities, but they don't stress that the annuity uses after-tax dollars. Because of this, a deductible retirement account like an IRA or 401(k) account is better than an annuity. Fixed annuities usually are expensive investments because you have to pay commissions to the agent who sells the annuity to you, and you have to pay insurance premiums for a small amount of insurance offered by the annuity. You also have to pay hefty surrender charges to the insurance company if you withdraw your money early. This is on top of any tax penalties you may face. In the early 1980s annuities offered other tax advantages, but these largely disappeared with the 1986 Tax Reform Act. Fixed annuities can be another tool you may want to use for your retirement planning, but there are better vehicles like your 401(k) or IRA that should be used first. Copyright 1997 by David Luhman

In April and May 2012, large trading losses occurred at JPMorgan's Chief Investment Office, based on transactions booked through its London branch. A series of derivative transactions involving credit default swaps (CDS) were entered, reportedly as part of the bank's "hedging" strategy.[1] Trader Bruno Iksil, nicknamed the London Whale, accumulated outsized CDS positions in the market. An estimated trading loss of $2 billion was announced, with the actual loss expected to be substantially larger. These events gave rise to a number of investigations to examine the firm's risk management systems and internal controls. In February 2012, hedge fund insiders such as Boaz Weinstein of Saba Capital Management[2][3] became aware that the market in credit default swaps was possibly being affected by aggressive trading activities. The source of the unusual activity turned out to be Bruno Iksil, a trader for JPMorgan Chase & Co. Heavy opposing bets to his positions had been made by traders, including another branch of JPMorgan, who purchased the derivatives that JPMorgan was selling in such high volume.[4][5] Early reports were denied and played down by the firm in an attempt to minimize exposure.[6] Major losses of $2 billion were reported by the firm in May 2012 in relation to these trades. On July 13, 2012, the total loss was updated to $5.8 billion with the addition of a $4.4 billion loss in the second quarter and subsequent recalculation of a loss of $1.4 billion for the first quarter. A spokesman for the firm claimed that projected total losses could be more than $7 billion.[7] The disclosure, which resulted in headlines in the media, did not disclose the exact nature of the trading involved, which remained in progress as of May 16, 2012 as JPMorgan's losses mounted and other traders sought to profit or avoid losses resulting from JPMorgan's positions.[8][9] As of June 28, 2012, JPMorgan's positions were continuing to produce losses which could total as much as $9 billion under worst-case scenarios.[10] The trades were possibly related to CDX IG 9, a credit default swap index based on the default risk of major U.S. corporations[11][12] that has been described as a "derivative of a derivative".[13][14] On the company's emergency conference call, JPMorgan Chase CEO Jamie Dimon said the strategy was "flawed, complex, poorly reviewed, poorly executed, and poorly monitored".[15] The episode is being investigated by the Federal Reserve, the SEC, and the FBI.[16] On February 2, 2012, at the Harbor Investment Conference, speaking to an audience of investors, Boaz Weinstein recommended buying the Markit CDX North America Investment Grade Series 9 10-Year Index, CDX IG 9.[17] This is a derivative that measures the spread (difference in interest rates) between the interest rates of investment-grade worthy companies and the London Interbank Offered Rate (LIBOR). (15 Aug 2017) LEADIN: Moroccan authorities have given the green light to participative banks, or so-called Islamic banks, to start offering their services to customers. STORYLINE: Two banks in Morocco have become the first to offer their customers financial services that adhere to Islamic law. After several months of waiting, the "Halal" banks have received the approval of the Higher Council of Ulamas, transmitted by Bank Al-Maghrib, the Moroccan central bank, to launch their activities. Bank Assafa and Umnia Bank were the first two banks to announce their official launch. "Today we see that there are a large number of customers who come to us to have information on the products of the participative finance and how it works," explains Youssef Baghdadi, General Director of Bank Assafa. "Our services are almost the same of others banks, only all our works must be certified by the superior council of Ulamas." For Bank Assafa, a subsidiary of Attijariwa Bank, this is the culmination of a long journey that began in 2010 with participative finance company Dar Assafa, now a fully-fledged bank. Umnia Bank, a participating subsidiary of CIH Bank and Qatar International Islamic, opened its doors to clients in all of its agencies located in Agadir, Casablanca, Fez, Marrakech, Oujda, Rabat, Sale and Tangier. For those who do not wish to travel, the two banks offer online portals that serve as digital agencies. Baghdadi thinks this will be a positive move for the Moroccan economy. "It can only be good for us Moroccans to have other supplementary offers on the market, and then everyone can choose whether or not it will be a conventional bank or a participatory bank." These banks have also been authorised to grant "Halal" real estate credits, called "Murabaha", but they can not offer insurance. The Murabaha contracts are also ratified by the Sharia Committee for Participatory Finance, the Higher Council of Ulamas (CSO) and sent to the banks by the Central Bank. "When I found out about the launching of the Murabaha process to finance a house or a car, I came here because it is in accordance with Islamic law," says customer Mustapha Laabssi. "I've been waiting for the start of participative banks in Morocco. Today I am here to have information about the financial products of the bank, and I hope that I find here what I am looking for." Islamic finance prohibits, amongst other things, the practice of interest and speculation as well as investment in gambling or pornography. Rather than pay interest, people buying a home enter into a contract of joint ownership with the bank and pay "rent" to live there. Many people support the introduction of these new services. Fatima Machkor and her husband Lahssen Moussaif flew over from Canada to help their son with buying a house. "We are satisfied with this bank, they provided us with all the facilities," says Machkor. "My son was happy with this bank who offers different services than traditional banks, I think the bank will have a continuity and a good future," agrees Moussaif. In Morocco, the Higher Council of the Ulamas, an official institution in charge of supporting the religious policy of the kingdom, is the only body authorised to issue fatwas (decrees) on the conformity of participatory finance products. Ten applications for accreditation were submitted to the Central Bank in June 2016, mainly by Moroccan banking groups associated with Islamic banks in the Gulf. Islamic finance, whose development prospects appear unlimited, now represents some 2,000 billion dollars (1,717 billion euros), and could double in volume to 4,000 billion dollars in 2020.
